Terms of Use
Starter text for internal review. Replace bracketed placeholders (for example [like this]) before publication. This page is not legal advice — have counsel review the final version.
1. Agreement to these terms
By accessing or using the website and services operated under the name The Watermill Club(the "Services"), you agree to these Terms of Use. If you do not agree, do not use the Services.
Additional terms may apply to specific features (for example host agreements, Stripe checkout terms, or experience-specific rules). Where those terms conflict with this document on a specific point, the more specific terms govern that point.
2. Who operates the Services
The Services are operated by [legal entity name — add], [registered address — add]. Contact: see the site footer or hello@thewatermillclub.com.
3. What the Services are
The Watermill Club offers a curated way to discover rural places and, where available, book day experiences or arrange motorhome stays through The Guild membership network. We provide a platform; independent hosts and producers are responsible for their listings, availability, and on-site hospitality. We are not a tour operator for every experience unless expressly stated otherwise in writing.
4. Accounts and eligibility
You must provide accurate information and keep your login secure. You are responsible for activity under your account. You must be at least the age required to enter a binding contract in your country (often 18) unless a feature explicitly allows younger users with parental consent.
5. Bookings, payments, and Guild membership
Prices, availability, and cancellation rules are shown at checkout or in the relevant listing. Payments are processed by our payment provider; their terms and your card issuer's rules also apply. Guild membership is a recurring subscription where you choose to join — billing terms are presented before you pay.
Nothing in these Terms is a substitute for reading the cancellation and refund information provided with the experience or booking you select. [Link to cancellation policy — add when published]
6. Conduct and acceptable use
You agree not to misuse the Services — for example by harassing hosts or guests, submitting false applications, or attempting to circumvent security or fees. We may suspend or terminate access where we reasonably believe this is necessary.
7. Content and intellectual property
The platform's branding, design, and original content are owned by us or our licensors. You may not copy or scrape the Services except as allowed by law or with our written permission. Content you submit (such as reviews or host descriptions) may be used to operate and promote the Services as described in our Privacy Policy.
8. Disclaimers
Rural travel involves weather, road conditions, and third-party services outside our control. The Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee uninterrupted access or that every listing will meet your expectations.
9. Limitation of liability
To the extent permitted by applicable law, we are not liable for indirect or consequential losses arising from your use of the Services. Our aggregate liability for claims relating to the Services in any twelve-month period may be limited to the amount you paid us in fees for the Services in that period (excluding payments passed through to hosts), or to the minimum amount allowed by law if higher — [confirm caps with counsel — this is a placeholder structure].
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted.
10. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access where we need to protect users, comply with law, or wind down a feature. Provisions that by their nature should survive (such as liability limits, where enforceable) will survive.
11. Governing law and disputes
This section should be completed by counsel for your operating jurisdiction. [Governing law: e.g. Republic of Estonia — add]. [Courts or arbitration — add].
12. Changes to these terms
We may update these Terms. We will post the revised version here and adjust the "Last updated" date. Continued use after changes may constitute acceptance, where permitted by law; for material changes, we may provide additional notice.
